Confidentiality and Non-Disparagement Provisions in Severance Agreements Restricted
The National Labor Relations Board recently rules that severance agreements with overly broad confidentiality and non-disparagement provisions are unlawful under the National Labor Relations Act. The ruling applies to most employers. If you utilize severance agreements, consult with legal counsel to determine how this impacts existing agreements and future practices.
